Amendments to the Code of Regulations

At the 2018 Muirfield Association annual meeting, residents voted on nine separate amendments, either in person or by proxy. Each amendment was passed by a majority vote. These Amendments were filed with the Delaware County Recorder's office on June 5, 2018 at Book 1574, Page 2309 et seq. and with the Franklin County Recorder's Office on June 11, 2018, at Instrument No. 201806110077226. The Amendments became binding and effective on the date they filed.

A copy of the Amendments should be filed with your copy of the Declaration (Warranty Deed) and Bylaws (Code of Regulations). These documents must be passed on to any future buyer of your home.

For those on paper communications, a copy of the amendments is scheduled to be mailed soon. It will arrive in a standard letter size Muirfield envelope. However, you are also welcome to read the Amendments onscreen, download a copy from the Amendments section of the Code of Regulations (By Laws) page or download from a link at the bottom of this email.

In summary, the amendments state that:

  1. The annual meeting will be held in April each year.
  2. As of the recording of the Amendment, Board members must be unit owners or spouses of unit owners and a member in good standing in order to serve on the Board.
  3. Board members will serve without compensation; however will be reimbursed for actual expenses incurred in the performance of their duties.
  4. Owners may now vote for the election of Board members.*
  5. The President, Vice President, Secretary, and Treasurer must be elected from the Board of Directors.
  6. The Board may create standing or special committees as deemed necessary.
  7. The Association may now expend up to 0.25% of the Association's annual operating budget on social activities, including holiday parties and community picnics, with the exception of alcohol.
  8. The Board has the authority to spend up to 25% of the estimated annual budget on capital improvements, not maintaining, repairing, or replacing existing components, to the common elements. A majority of the owners must approve any spending above 25% of the annual budget.

Note: although the text of the amendments is exactly the same for both Franklin and Delaware counties, we were required to file the document with each county individually. Consequently, there is one document for those who have a Muirfield home in Delaware County and another for those whose Muirfield home is in Franklin County. However, these documents contain the same information.
